Terms of Service

These Terms of Service ("Terms") govern your access to and use of the blazed.sh platform (the "Service"). By creating an account or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

blazed.sh is operated by BLAZED.sh – a project of Liermann Engineering, Bachstr. 162, 42781 Haan, Germany ("blazed.sh", "we", "us").

1. Definitions

  • "Account" – The user account you create to access the Service.
  • "Beta Plan" – Any free‑of‑charge or pre‑release plan identified as "beta", "preview", "experimental" or similar.
  • "Content" – Code, images, data, text, or other material uploaded to or generated on the Service.
  • "Customer" / "you" – The natural or legal person that accepts these Terms.

2. Eligibility & Account Security

You must be at least 18 years of age and legally capable of entering into binding contracts. You are responsible for safeguarding your Account credentials and for all activities under your Account.

3. Scope of Service

blazed.sh provides a Platform‑as‑a‑Service for hosting Docker containers. The Service is in an experimental state and may contain defects, experience interruptions, or change without notice.

4. Beta Plan – No Service Level Agreement (SLA)

If you use a Beta Plan, no uptime guarantee or SLA is provided. The Service may be unavailable at any time, including for maintenance, testing, or unforeseen outages. We do not compensate for downtime or degradation of Service on Beta Plans.

5. Fees & Payment

Paid plans, usage‑based fees, and billing cycles are described on our website or in your Account dashboard. Prices are exclusive of VAT unless stated otherwise. You authorise us to charge the payment method on file for all fees when due.

6. Intellectual Property

We retain all rights, title, and interest in and to the Service, including all related intellectual property. These Terms do not grant you any ownership rights to the Service.

You retain ownership of Content you upload. By hosting Content on the Service, you grant us a non‑exclusive licence to store, execute, and transmit that Content as necessary to provide the Service.

7. Acceptable Use

You must not:

  • Use the Service to violate any applicable law or regulation.
  • Infringe intellectual‑property or privacy rights.
  • Deploy malware, perform penetration tests, or expose the Service to excessive load without written permission.
  • Attempt to circumvent security or access controls.
  • Interfere with or disrupt the integrity or performance of the Service.

We may suspend or terminate your Account for violations.

8. Confidentiality

Beta Plan features and documentation are confidential. You must not disclose benchmark results, screenshots, or non‑public information about the Service without our prior written consent.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We disclaim all warranties, including merchantability, fitness for a particular purpose, and non‑infringement. We do not warrant that the Service will be uninterrupted, secure, or error‑free.

10. Limitation of Liability

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential or punitive damages, including lost profits, lost revenue, lost savings, or business interruption, even if we have been advised of the possibility of such damages.

Our aggregate liability arising out of or relating to the Service shall in no event exceed the total amount paid by you to us for the Service in the 12 months preceding the claim (or €0 if you use only the Beta Plan).

Nothing in these Terms limits liability that cannot be limited under German law, including liability for intent, gross negligence, injury to life, body or health, or under the German Product Liability Act.

11. Indemnification

You will indemnify and hold blazed.sh harmless from any third‑party claims arising out of your Content or your violation of these Terms.

12. Suspension & Termination

We may suspend or terminate the Service or your Account at any time with reasonable notice. You may cancel your Account at any time via the dashboard.

Upon termination, your right to use the Service will cease immediately and we may delete your Content after 30 days. Sections 6, 8–11, 13 and 14 survive termination.

13. Governing Law & Venue

These Terms are governed by German law. If you are a merchant (§ 14 BGB), the exclusive venue for disputes arising out of or in connection with these Terms is Düsseldorf, Germany.

14. Changes to the Terms

We may modify these Terms at any time. We will notify you of material changes via the Service interface. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.

15. Severability

If any provision of these Terms is held invalid, the remaining provisions will remain in full force.

16. Entire Agreement

These Terms constitute the entire agreement between you and blazed.sh regarding the Service and supersede all prior agreements.
